Surety payable to state--Conditions required

The surety required by §
45-6B-20
shall be payable to the State of South Dakota and conditioned upon the operator's faithful performance of all requirements of this chapter and compliance with the terms of the operating and reclamation plans approved by the Board of Minerals and Environment. If a corporate surety bond is required, such bond shall be signed by the operator as principal and by a surety insurer certified under chapter
58-21
. Such surety shall remain in effect until the affected land has been reclaimed, the reclamation is approved by the board and is released by the board.
