Violation of adopted standards by land

Upon the determination by the conservation district, pursuant to §
38-8A-20
, that a land

disturbing activity is violating adopted standards, the land disturber shall be required to prepare an erosion and sediment control plan within six months, and have the plan approved by the local conservation district. Upon approval of the plan by the conservation district, the land disturber shall be allowed six months to implement the plan.
