The person alleged to meet the criteria for board - ordered commitment shall be represented by counsel. Such representation is not subject to waiver, and the person is entitled: (1) To be present at the hearing; (2) To obtain a continuance in order to adequately prepare a case; (3) To present documents and witnesses; (4) To cross - examine witnesses; and (5) To require testimony in person from the psychiatrist or psychologist who performed the evaluation required in 27B-7-28 .
