South Dakota Code § 25-7-7.7

Termination of child support order upon disestablishment of paternity
Open in Lexace · Ask the AI about this section
If a presumed or legally determined father has a child support order and disestablishes his paternity pursuant to §
25-8-64
, the child support order is automatically terminated from entry of the disestablishment order. The disestablished father continues to be responsible for any child support that accrued prior to the date of entry of the disestablishment order. However, nothing in this section precludes the disestablished father from bringing a separate cause of action for recovery of previously ordered child support.
