Any resident of this state who is under twenty-one and has a hearing status that precludes receiving educational benefits through a public school is entitled to receive services through South Dakota Services for the Deaf. South Dakota Services for the Deaf may assist any person who is not a resident of the state, provided: (1) The person meets the criteria established in this section; (2) The Board of Regents determines that no resident of this state is denied assistance as a result; and (3) Payment is received for any charges established by the Board of Regents.
