South Dakota Code § 12-27-21

Contribution or loan from public or foreign entity--Prohibition--Penalty

A candidate or political committee may not accept any contribution or loan from:
(1) A state;
(2) A state agency;
(3) A political subdivision of a state;
(4) A foreign government;
(5) A foreign national, as defined in 52 U.S.C. § 30121(b) (January 1, 2026);
(6) A federal agency; or
(7) The federal government.
A violation of this section is a Class 1 misdemeanor. A subsequent offense within a calendar year is a Class 6 felony.
