Sale, transfer, or negotiation to sell lots before approval and recording of plat as petty offense--Injunction

It is a petty offense for the owner or agent of the owner of the land located within the platting jurisdiction of any municipality as described in §
11-6-26
, knowingly or with intent to defraud, to transfer or sell, to agree to sell, or to negotiate to sell such land by reference to or exhibition of or by other use of a subdivision of such land before the plat has been approved by the council and recorded in the office of the register of deeds, for each lot so transferred or sold or agreed or negotiated to be sold. The description by metes and bounds in the instrument of transfer or other document used in the process of selling or transferring shall not exempt the transaction from the penalties. A municipality may enjoin such transfer or sale or agreement by action for injunction.
