A game fish taken by net or other nongame fishing device, except for landing nets (dip nets), must be returned immediately to the water from whence it came. A person violating the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not less than fifty dollars nor more than two hundred dollars or imprisoned for not more than thirty days. Any equipment used in committing the offense must be seized and disposed of as provided by law. Effect of Amendment The 2012 amendment renumbered and rewrote the section. 2022 Act No. 137, SECTION 6, in the first sentence, inserted "except for landing nets (dip nets)," following "fishing device,".
