The Division shall establish a comprehensive and coordinated program of treatment for chemically dependent persons utilizing, to the extent financial resources allow, services of other state agencies, local facilities, and private treatment facilities. The program may include: (1) emergency treatment provided by a physician affiliated with or part of the medical service of a general hospital; (2) inpatient treatment; and (3) outpatient treatment and follow-up treatment, or all of them. The Division may contract for the use of any public or private facility as an approved treatment facility if the Division, subject to the approval of the Department of Behavioral Health and Developmental Disabilities, considers this to be an effective and economical course to follow. Code Commissioner's Note At the direction of the Code Commissioner, certain references in the S.C. Code to the State Department of Mental Health, South Carolina Mental Health Commission, Department of Disabilities and Special Needs, Department of Disabilities and Special Needs Commission, Department of Alcohol and Other Drug Abuse Services, and other related terms were changed to reflect the restructuring of these agencies into component offices under the Department of Behavioral Health and Developmental Disabilities, pursuant to 2025 Act No. 3, SECTION 18.
