(A) An agent means a person who is appointed or employed by a health maintenance organization and who engages in solicitation of membership in the organization. This definition does not include a person enrolling members on behalf of an employer, union, or other organization to whom a master subscriber contract has been issued. (B) The department may by regulation exempt certain classes of persons from the requirement of obtaining a license: (1) if the functions they perform do not require special competence, trustworthiness, or the regulatory surveillance made possible by licensing; or (2) if other existing safeguards make regulation unnecessary.
