(a) It is a misdemeanor for any person, in offering his or her services to the public, to: (1) Use in connection with his or her name any designation tending to imply that he or she is a licensed applied behavior analyst, licensed applied behavior assistant analyst, or psychologist with equivalent experience to render services defined as the practice of behavior analysis, unless licensed under the provisions of this chapter; (2) Use in connection with his or her name any designation tending to imply that he or she is a licensed applied behavior analyst, licensed applied behavior assistant analyst, or psychologist with equivalent experience to render services defined as the practice of behavior analysis, during the time his or her license issued under the provisions of this chapter is suspended or revoked; or (3) Otherwise violate any of the provisions of this chapter or the rules and regulations promulgated hereunder. (b) These misdemeanors shall be punishable by a fine of not more than five hundred dollars ($500) for each offense.
