Patient’s rights

Pursuant to this chapter, a patient who has his or her confidential healthcare information included in the HIE shall have the following rights: (1) To obtain a copy of his or her confidential healthcare information from the HIE; (2) To obtain a copy of the disclosure report pertaining to his or her confidential healthcare information; (3) To be notified as required by chapter 49.3 of title 11, the Rhode Island identity theft protection act, of a breach of the security system of the HIE; (4) To change his or her opt out status in the HIE in accordance with rules and regulations promulgated by the department; (5) To request to amend his or her own information through the provider participant; (6) To request his or her confidential healthcare information from the HIE be disclosed to an authorized representative; and (7) To request his or her confidential healthcare information from the HIE be disclosed to healthcare providers who are not provider participants as defined by this chapter.
