(a) It is the policy of the department not to require a parent to surrender physical possession or custody of his or her minor child or children based solely upon the department’s provisions of services to the family. A surrender shall be determined by the family court or as otherwise provided by law. (b) In all cases the best interest of the minor child or children shall be paramount.
