Proceeds of sales — Segregated funds

(a) All proceeds from the sale of lottery tickets or shares received by a person in the capacity of a sales agent shall constitute a trust fund until paid into the state lottery fund. (b) The sales agent shall be personally liable for all proceeds; and failure to pay the lottery division moneys owed, upon demand, from the sales or misappropriation of the funds shall constitute embezzlement under § 11-41-3. (c) The provisions of this section shall be enforced and prosecuted by the state police and the attorney general’s office.
