Disbursements from tardy account fund — Unexpended balance

(a) The moneys in the tardy account fund shall be used solely for the following purposes: (1) To make refunds of penalties erroneously collected and deposited in the fund; and (2) To maintain essential department programs. (b) The general treasurer shall pay all vouchers duly drawn by the director upon the fund, in any amounts and in any manner that the director may prescribe. Vouchers so drawn upon the fund shall be referred to the controller within the department of administration. Upon receipt of these vouchers, the controller shall immediately record and sign them and shall promptly transfer the signed vouchers to the general treasurer. These expenditures shall be used solely for the purposes specified in this section, and its balances shall not lapse at any time.
