(a) Local preemption.-- This subchapter preempts and supersedes all ordinances, policies and rules of a local authority relating to highly automated vehicles. (b) Construction.-- (1) Nothing in subsection (a) shall be construed to prohibit local authorities on streets or highways within their physical boundaries from the reasonable exercise of their police powers specified in section 6109 (relating to specific powers of department and local authorities), provided that the exercise of the police powers does not specifically burden or discriminate against highly automated vehicles. (2) An ordinance, policy or rule that affects the operation of the highly automated vehicle as a member of a type or class of vehicle, motor vehicle or traffic shall not be a violation of subsection (a).
