(a) Legality.-- A complaint as to the legality of an ordinance or a resolution must be made to a court of common pleas under 42 Pa.C.S. § 5571.1 (relating to appeals from ordinances, resolutions, maps, etc.). (b) Legality and propriety.-- For an ordinance laying out streets over private lands, the court has jurisdiction to review the propriety and legality of the ordinance.
