(a) Contracts.-- The department may enter into contracts with well control specialists in order to provide adequate emergency response services in the event of a well control emergency. The department shall make available, upon request by a county, information relating to contracts with well control specialists. (b) Civil immunity.-- Except as set forth in subsection (c), a well control specialist with which the department has entered into a contract under subsection (a) shall be immune from civil liability for actions taken in good faith to carry out its contractual obligations. (c) Nonapplicability.-- Subsection (b) shall not apply to damage arising from any of the following: (1) Breach of the contract under subsection (a). (2) An intentional tort. (3) Gross negligence.
