(a) Scope of section.-- This section applies to a constable subject to all of the following: (1) The constable is entrusted with the execution of a process for the collection of money. (2) The constable, by neglect of duty, fails to collect the money. (3) The constable's security is used to pay the money. (b) Equitable interest.-- The person that pays the security under subsection (a)(3): (1) has an equitable interest in the judgment; and (2) may collect the judgment in the name of the party that won the judgment.
