(1) Every locomotive of every railroad operating in this state shall be equipped with a first aid kit. (2) All locomotives shall be equipped with fire extinguishers meeting the following requirements: (a) Each locomotive shall have at least one portable fire extinguisher. (b) Fire extinguishers may be of a foam, dry chemical or carbon dioxide type. (c) The fire extinguishers in each locomotive shall provide a minimum capacity of one and one-quarter gallons or five pounds. More than one fire extinguisher may be used to comply with the minimum capacity requirement under this paragraph. (d) Fire extinguishers shall be placed in readily accessible locations. (e) Fire extinguishers shall be maintained in working order. (3) A railroad may apply for a temporary exemption from the provisions of subsection (2) of this section. The Department of Transportation will consider the application of the railroad for a temporary exemption when accompanied by a full statement of the conditions existing and the reasons for the exemption.
