Authority of rural ports to operate telecommunications facilities; exceptions

(1) A rural port may construct, purchase, acquire, develop, finance, lease, license, handle, provide, add to, contract for, interconnect, alter, improve, repair, operate and maintain any telecommunications facilities within or without the ports limits for the ports own use.
(2) This section does not authorize a rural port to provide telecommunications services to end users.
(3) A rural port may not exercise powers of eminent domain to acquire telecommunications infrastructure or facilities or contractual rights to telecommunications infrastructure or facilities held by any other person or entity.
(4) As used in this section, rural port means a port that has a population of less than 750,000 within its territorial boundaries.
