(1) The Oregon State Board of Nursing may establish and collect fees necessary to carry out the provisions of ORS 678.010 to 678.448. (2) Fees are refundable at the discretion of the board. (3)(a) The board shall obtain approval from the Oregon Department of Administrative Services prior to establishing fees under this section. (b) A fee established and collected under this section may not exceed the cost of administering a regulatory program for which the fee is established and collected, as authorized by the Legislative Assembly within the Oregon State Board of Nursing budget, subject to modification by the Emergency Board. (c) If federal or other funds are available to offset costs of administering the program, fees shall be established based on net costs to the state but may not exceed $75 per biennium for a nursing assistant certification.
