(1) ORS 658.005 to 658.245 do not apply to a rehabilitation services agency. (2) As used in this section: (a) A rehabilitation services agency means an individual, partnership or corporation that: (A) Holds itself out to the public as such; (B) Is certified by the Department of Consumer and Business Services to perform rehabilitation services pursuant to ORS chapter 656; (C) Exclusively provides services to clients who are injured workers or individuals with physical or mental disabilities; and (D) Receives the major portion of the fee for services to the clients from a government agency, an insurer, self-insured employer or person other than the client. (b) Services to the client may include, but are not limited to medical evaluation, physical rehabilitation, vocational rehabilitation, employment counseling, job analysis, job site modification, job placement, on-the-job training or other short term training program.
