(1) In accordance with the provisions of ORS chapter 183, the State Department of Agriculture may promulgate rules necessary to administer and enforce the provisions of ORS 632.705 to 632.815, including but not limited to: (a) The establishment of fees under ORS 632.741, and the times and manner of payment thereof; (b) The reports and records to be made or kept under ORS 632.741; (c) The establishment of minimum grades or standards of quality and wholesomeness, size or weight of eggs or egg products; (d) The establishment of minimum standards of construction, maintenance, sanitation and operation of facilities and equipment used in the grading, candling, breaking or processing of eggs or egg products; and (e) The establishment of labeling and advertising standards or requirements for eggs and egg products. (2) In promulgating such rules the department may consider: (a) The provisions of the federal Act and rules promulgated pursuant thereto, and the laws and rules of other states; (b) The necessary procedures required to prohibit the sale or consumption of unwholesome eggs or egg products; and (c) The health and economic consequences to this state which might result from the processing, handling, sale or consumption of unwholesome eggs or egg products.
