(1) A person commits the crime of unlawfully obtaining a dog or cat if the person: (a) Is an animal dealer; and (b) Obtains a companion animal or the offspring of a companion animal from a person who has not raised the companion animal or the offspring of the companion animal on the persons own premises. (2) Unlawfully obtaining a dog or cat is a Class A misdemeanor. (3) It is an affirmative defense to a charge of violating subsections (1) and (2) of this section that an animal dealer, having received a companion animal or the offspring of a companion animal in violation of subsections (1) and (2) of this section, delivers the companion animal or the offspring of the companion animal to an animal shelter within 24 hours of acquisition.
