For the purpose of requesting a state or nationwide criminal records check under ORS 181A.195, the State Forestry Department may require the fingerprints of a person who: (1)(a) Is employed or is applying for employment by the department; or (b) Provides services or seeks to provide services to the department as a contractor or volunteer; and (2) Is, or will be, working or providing services in a position: (a) That provides forest education or recreation programs for persons under 18 years of age; or (b) In which the person investigates or fights wildland fires and the criminal records check is requested to search for crimes associated with arson. Note: 526.054 was enacted into law by the Legislative Assembly but was not added to or made a part of ORS chapter 526 or any series therein by legislative action.
