Oregon Code § ORS 469.900

Duty of commission to avoid conflict with federal requirements

(1) The Public Utility Commission shall insure that each electric utilitys commercial energy conservation services program does not conflict with federal statutes and regulations applicable to electric utilities and energy conservation in commercial buildings.
(2) The commission shall insure that each gas utilitys commercial energy conservation services program does not conflict with federal statutes and regulations applicable to gas utilities and energy conservation in commercial buildings.
(3) The Director of the State Department of Energy shall insure that each covered publicly owned utilitys commercial energy conservation services program does not conflict with federal statutes and regulations applicable to covered publicly owned utilities and energy conservation in commercial buildings.
