(1) In the case of abuse of a resident in a long term care facility, the privileges created in ORS 40.230 to 40.255, including the psychotherapist-patient privilege, the physician-patient privilege, the privileges extended to nurses, to staff members of schools and to regulated social workers and the spousal privilege, shall not be a ground for excluding evidence regarding a residents abuse, or the cause thereof, in any judicial proceeding resulting from a report made pursuant to ORS 441.630 to 441.680. (2) In any judicial proceedings resulting from a report made pursuant to ORS 441.630 to 441.680, either spouse shall be a competent and compellable witness against the other. (3) As used in this section, abuse and facility have the meanings given those terms in ORS 441.630. Note: 441.674 was enacted into law by the Legislative Assembly but was not added to or made a part of ORS chapter 441 or any series therein by legislative action.
