Status of public universities as governmental entities

A public university listed in ORS 352.002 is a governmental entity performing governmental functions and exercising governmental powers. A public university listed in ORS 352.002 is not considered a unit of local or municipal government or a state agency, board, commission or institution for purposes of state statutes or constitutional provisions.
(Temporary provisions relating to the definition of State Board of Higher Education for bonding purposes)
Note: Section 220, chapter 767, Oregon Laws 2015, provides:
Sec. 220. For purposes of Article XI-M, section 1, of the Oregon Constitution, a building owned by the State Board of Higher Education includes a building owned by:
(1) The State Board of Higher Education on the date before August 14, 2013, that, as a result of sections 2 and 3 of this 2015 Act and the amendments to ORS 352.054 by section 1 of this 2015 Act, is on the effective date of this 2015 Act [July 27, 2015] owned by another agency or public corporation of this state and used for purposes within the authority of the board on the date before the effective date of this 2015 Act.
(2) An agency or public corporation of this state on or after the effective date of this 2015 Act and used for purposes within the authority of the board before the effective date of this 2015 Act.
