(1) Whenever the electors registered in contiguous territory desire the formation of a community college district, they may sign a petition requesting the formation of such a district and present it to the Higher Education Coordinating Commission. (2) The petition must be substantially in the form established by the commission, which shall furnish the petition form. The petition: (a) Must contain the minimum number of signatures fixed by the commission of 500, or 10 percent of the electors registered in each county or part of a county within the designated territory, whichever is the lesser; (b) Must designate the boundaries of the territory to be included in the proposed district, which may include all or part of the territory lying within the boundaries of a school district and may be located in more than one county; (c) Must request that the territory be organized into a district; (d) May specify or reserve the right to specify the location for the proposed community college or may request the commission to determine the location; (e) Must specify the method of nomination and election of the board of education of the proposed district from among the methods described in ORS 341.327; and (f) Must contain any other information required by rules of the commission.
