(1) Except as otherwise provided by section 30, Article IV of the Oregon Constitution, notwithstanding any statute or salary plan establishing the salary for a position in the exempt, unclassified or management service, a Senator or Representative who is appointed to a position in the exempt, unclassified or management service during the Senators or Representatives term of office shall receive a salary established as follows: (a) If the salary for the position to which the Senator or Representative is appointed has been increased during the Senators or Representatives term of office, the Senator or Representative shall receive a salary equal to that established for the position immediately prior to the commencement of the Senators or Representatives term of office until the term of office of the Senator or Representative expires. (b) If the salary for the position to which the Senator or Representative is appointed decreased or remained unchanged during the Senators or Representatives term of office, the Senator or Representative shall receive the salary established by the applicable statute or salary plan. (2) As used in this section, term of office means the particular four-year or two-year period for which the Senator or Representative was elected pursuant to section 4, Article IV of the Oregon Constitution. In the event that the Senator or Representative was appointed to fill a vacancy in the Legislative Assembly, term of office means the remainder of the four-year or two-year period for which the Senator or Representative was appointed, beginning on the date of appointment. Term of office does not mean the Senators or Representatives duration of service in the Legislative Assembly.
