Notwithstanding any other provision of this chapter or ORS chapter 195 or 197, a county may provide, or may enter into an agreement with a city or district including under ORS 195.065 to 195.085 to provide, water or wastewater services for residential dwelling units that are within a ground water quality concern area declared under ORS 468B.175 or a ground water quality management area declared under ORS 468B.180 and not within an urban growth boundary. The provision of services under this section or ORS 215.213 (1)(c)(D) or 215.283 (1)(c)(D) may not be used to authorize the rezoning of property for urban uses or used as the basis for an exception under ORS 197.732 (2)(a) or (b). Note: 215.256 was added to and made a part of ORS chapter 215 by legislative action but was not added to any smaller series therein. See Preface to Oregon Revised Statutes for further explanation.
