(1) The office of the county clerk in every county shall establish regular business hours to receive and certify, as required under ORS 93.620, instruments presented for recording, for a minimum of four hours per day, and 30 hours per week, from Monday through Friday. (2) Notwithstanding subsection (1) of this section: (a) The county clerk may reduce the number of regular business hours below the minimums required under subsection (1) of this section for: (A) A holiday recognized by the county governing body; (B) A state of emergency declared at the local, state or federal level; or (C) An event that poses a safety risk to the public or staff of the office. (b) The county clerk may reduce the number of regular weekly business hours to less than 30 for training programs of the office of the county clerk, not to exceed two business day closures per year. (3)(a) Notwithstanding subsection (1) of this section, the county governing body may modify the regular business hours of the office of the county clerk for a fiscal year upon adoption of a resolution in which the governing body determines in its sole discretion that a fiscal emergency exists in the county. (b) A resolution adopted under this subsection may be renewed, amended or repealed by the county governing body. (c) The regular business hours established under subsection (1) of this section may not be reduced under a resolution to a greater extent than the regular business hours of other nonemergency county services housed within the same building are reduced.
