(1) A notary public is responsible for the security of the notary publics stamping device and may not allow another individual to use the device in performing a notarial act. (2) On resignation from, or the revocation or expiration of, the notary publics commission, or on the expiration date set forth in the notary publics official stamp, the notary public shall disable the notary publics stamping device by destroying, defacing, damaging, erasing or securing the device against use. (3) On the death or adjudication of incompetency of a notary public, the notary publics personal representative, guardian, conservator or trustee or any other person knowingly in possession of the notary publics stamping device shall render the device unusable by destroying, defacing, damaging, erasing or securing the device against use. (4) If a notary publics stamping device is lost or stolen, the notary public or the notary publics personal representative, guardian, conservator or trustee shall notify promptly the Secretary of State on discovering that the device is lost or stolen.
