Title 69. Roads, Bridges, And Ferries: Reimbursement for actual damages

The Department shall make reimbursement for any actual damages
resulting to such lands, waters, premises and property as a result
of activities pursuant to the preceding section.  In the event of
disagreement as to the amount of the damage, either the person
damaged or the Department may file a petition with the district
court for the appointment of commissioners to appraise the damages
and proceed to have the same determined as in condemnation
proceedings.
