Title 69. Roads, Bridges, And Ferries: Grant of right to close, inundate, destroy, alter or

appropriate county highway for public purposes.

The board of county commissioners of each county, by and with the
written approval of the Commission, may grant to the United States
of America or any irrigation district, conservancy district or water
user's association, organized under the laws of the state, the right
to close, inundate, destroy, alter or appropriate any county highway
in such county in connection with the construction, development,
operation or maintenance of any irrigation, reclamation, water
conservation and utilization, flood control, military or national
defense project, for needful public buildings, or other public
projects being constructed, operated, developed or maintained by the
United States of America, or any such district or association, upon
such terms and conditions and for such consideration as the board of
county commissioners may determine to be just and proper.  The grant
of any such right or rights may include the right to construct
irrigation ditches and canals across and along any such highway.
