Title 69. Roads, Bridges, And Ferries: Disposal of surplus road machinery and equipment

A.  Any surplus road machinery and equipment in excess of the
needs of the Department of Transportation which was purchased
pursuant to the provisions of this act shall be offered for sale to
all counties before it is disposed of.  Whether sold to a county or
sold as otherwise provided by law, the proceeds derived from selling
surplus road machinery and equipment shall be deposited with the
State Treasurer to be credited to the County Road Machinery and
Equipment Revolving Fund.
B.  Whenever any county owns road machinery and equipment which
it deems as surplus it may request the Department of Transportation
to dispose of said equipment.  If so requested, the Department in

turn shall issue notice to all counties of county-owned surplus road
machinery or equipment available at fair market value.  If no other
county offers to purchase said machinery or equipment the Department
may, at the request of the county owning the road machinery or
equipment, sell said machinery or equipment as otherwise provided by
law and return the proceeds to the county to whom the machinery or
equipment belonged.
C.  If a county disposes of its surplus road machinery and
equipment, it shall do so pursuant to Sections 421 et seq. of Title
19 of the Oklahoma Statutes.
