Title 61. Public Buildings And Public Works: Design-build as project delivery method for public water

supply, wastewater treatment facilities and wastewater collection
systems.
A.  For purposes of this section, "design-build" means a project
delivery method in which one entity works under a single contract
with the project owner to provide design and construction services.
B.  A conservancy district formed pursuant to Section 541 of
Title 82 of the Oklahoma Statutes, a municipality, a county, a
public trust, and any other political subdivision in this state that
operates a public water supply system or wastewater treatment or
collection system is authorized to utilize design-build as a project
delivery method for public water supply and wastewater treatment
facilities and wastewater collection systems.
C.  No later than November 1, 2022, the Department of
Environmental Quality shall incorporate into its administrative
rules a flexible permitting process to allow the utilization by the
entities identified in subsection B of this section of the design-
build project delivery method for public water supply and wastewater
treatment facilities and wastewater collection systems.
D.  In the interim between the effective date of this act and
promulgation of rules, the Department may authorize no more than
five pilot projects in which the entities identified in subsection B
of this section may utilize the design-build project delivery method
for public water supply and wastewater treatment facilities and
wastewater collection systems, and the Department may use the
results to promulgate rules.
