Title 46. Mortgages: Conveyance by holder of deed intended as security as

Any conveyance other than as above provided, by one holding
under an instrument purporting to be a conveyance, but intended as
security, shall be deemed and treated as an assignment and transfer
of the mortgage rights of and indebtedness due the maker thereof.
