possession. A. As used in this section, "powdered alcohol" means alcohol prepared or sold in a powder form for either direct use or reconstitution. B. It is unlawful for any person or licensee to use, offer for use, purchase, offer to purchase, sell, offer to sell or possess powdered alcohol. C. It is unlawful for a holder of a license pursuant to the provisions of this title for on-premises or off-premises consumption of alcoholic beverages to use powdered alcohol as an alcoholic beverage. D. Any person or license holder that violates this section shall, upon conviction, be guilty of and punished as follows: 1. For a first offense, a misdemeanor punishable by a fine of not more than Three Hundred Dollars ($300.00), or by imprisonment for not more than thirty (30) days, or by both; 2. For a second offense, a misdemeanor punishable by a fine of not more than Seven Hundred Fifty Dollars ($750.00), or by imprisonment for not more than six (6) months, or by both; or 3. For a third or subsequent offense, a D3 felony offense punishable by a fine of not more than Three Thousand Dollars ($3,000.00), or by imprisonment as provided for in subsections B through F of Section 20P of Title 21 of the Oklahoma Statutes, or by both.
