Title 36. Insurance: Agreement between provider and insurer or organization —

Changes to agreement.
A.  An insurer or prepaid vision plan organization shall not
change or alter an agreement entered into with a vision care
provider unless the insurer or organization:

1.  Provides notice of any proposed change to the provider
through a certified letter or an electronic communication requiring
an electronic signature proving receipt detailing proposed changes
to the vision care provider.  A face-to-face or virtual meeting
shall be conducted if requested by the provider.  If the changes in
the contract are not agreed to by the vision care provider within
ninety (90) days of the date of the provided notice, the agreement
shall terminate; and
2.  Supplies the vision care provider with an explanation of
benefits and an explanation of payment for services and materials
rendered by the provider upon request, regardless of the provider’s
network status with the vision plan.
B.  1.  A new agreement is required to be established and agreed
upon after three or more material changes are made to an existing
agreement from an insurer, vision plan, or vision care discount
plan.
2.  Any amendment to a proposed contract that is being reviewed
by a provider prior to its execution and any amendment to an
existing contract with a service provider shall be underlined to
clearly indicate the contract modification.
