Title 36. Insurance: Cease and desist orders and modifications thereof

A.  If, after a hearing or waiver of the right to a hearing, the
Insurance Commissioner shall determine that the method of
competition or the act or practice in question is defined in Section
1204 of this title and that the person complained of has engaged in
a method of competition, act or practice in violation of this
article, the Commissioner shall reduce these findings to writing and
shall issue and cause to be served upon the person charged with the
violation an order requiring the person to cease and desist from
engaging in such method of competition, act or practice.
B.  Until the expiration of the time allowed under subsection A
of Section 1208 of this title for filing a petition for review, if
no such petition has been duly filed within such time, or if a
petition for review has been filed within such time, then until the
transcript of the record in the proceeding has been filed in the
court, as hereinafter provided, the Commissioner may at any time,
upon such notice and in such manner as the Commissioner shall deem
proper, modify or set aside in whole or in part any order issued by
the Commissioner under this section.
C.  After the expiration of the time allowed for filing a
petition for review, if no petition has been duly filed within such
time, the Commissioner may at any time, after notice and opportunity
for hearing, reopen and later, modify or set aside, in whole or in
part, any order issued by the Commissioner under this section
whenever in the Commissioner's opinion conditions of fact or of law
has so changed as to require such action or if the public interest
shall so require.
