Title 27A. Environment And Natural Resources: Complaints program

A.  The complaints program shall, in addition to the
responsibilities specified by Section 2-3-101 of this title, refer,
upon written request, all complaints in which one of the
complainants remains unsatisfied with the Department's resolution of
said complaint to an outside source trained in mediation.
Complainants and persons named in the complaint shall be made aware
that participation in the mediation process conducted by the outside
source is completely voluntary and confidential.  Fulfillment of any
agreements reached in mediation shall be up to the parties of the
dispute.  Participation in the mediation process shall not hinder or
interfere with any enforcement action taken by the Department.
Mediation may run parallel to any enforcement action.  Participation
by a complainant in the mediation process shall not preclude such
complainants from seeking other relief provided by law.
B.  The complaints program shall maintain a roster of certified
mediators which will be available to the public.
C.  The complaints program shall document the outcome of
mediations to determine compliance with mediated agreements and for
documentation of program success.
