Any person who shall willfully or maliciously tear down or
deface any legal notice posted on any mining claim, or take up or
destroy any stakes or monument used for marking such mining claims,
or who shall willfully or maliciously throw or place any dirt,
water, brush, stones or other foreign substance into any mining
shaft or tunnel belonging to or claimed by another, or who shall
wilfully or maliciously alter, erase, deface or destroy any record
kept by any legally elected mining recorder shall be deemed guilty
of a misdemeanor and shall upon conviction thereof be punished by a
fine of not less than Twenty-five Dollars ($25.00) nor more than One
Hundred Dollars ($100.00), or by imprisonment for not less than ten
(10) days nor more than six (6) months or by both such fine and
imprisonment.
