A. Upon receiving the report of the returns of an election and referendum, the Commissioner shall determine: 1. The number of votes cast for and against the referendum proposition; 2. The total volume of production of the commodity during the relevant production period; 3. The percentage of the total volume of production of the commodity that was produced by those voting in favor of the referendum proposition; and 4. The appropriate number of candidates receiving the highest number of votes for membership on the commodity producers board. B. A successor organization shall follow the board election procedures set in the bylaws of the successor organization and the statutory assessment provisions for the particular commodity represented by the successor organization.
