A. Licenses shall expire on June 30 of each year and may be renewed upon payment of the license and swine animal unit fees set forth in this section and continued compliance with the provisions of the Oklahoma Swine Feeding Operations Act and the rules of the Board. B. The fees for a swine feeding operations license and annual renewal thereof shall be: 1. Fifteen Dollars ($15.00) for facilities with a capacity of less than two hundred fifty (250) swine animal units; 2. Thirty-seven Dollars and fifty cents ($37.50) for facilities with a capacity of two hundred fifty (250) to five hundred (500) swine animal units; 3. Seventy-five Dollars ($75.00) for facilities with a capacity of five hundred one (501) to three thousand (3,000) swine animal units; 4. One Hundred Fifty Dollars ($150.00) for facilities with a capacity of three thousand one (3,001) to ten thousand (10,000) swine animal units; or 5. Two Hundred Twenty-five Dollars ($225.00) for facilities with a capacity of more than ten thousand (10,000) swine animal units. C. 1. All licensed managed feeding operations shall pay an additional license fee for original licenses in an amount equal to eighty cents ($0.80) per licensed swine animal unit capacity. One- half (1/2) of the amount shall be due and payable with the application. 2. The other one-half (1/2) of the amount shall be due thirty (30) days from the date the application is approved. In the event the application is not approved, any amount of the fee in excess of the costs of processing the application shall be refunded to the applicant. 3. All licensed managed feeding operations shall pay an additional license fee for renewal licenses in an amount established by rules. D. The Department shall review costs related to the administration, regulation, and enforcement of licensed managed feeding operations. Based on the review, rules shall be promulgated pursuant to the Administrative Procedures Act establishing a renewal fee for licensed managed feeding operations. The fee shall be based on the costs incurred by the Department in salaries, travel claims, and other necessary expenses incurred in fulfilling its regulatory and administrative obligations with regard to licensed managed feeding operations. Under no circumstances shall the fee exceed eighty cents ($0.80) per swine animal unit. E. All fees received for licensure of swine feeding operations shall be deposited in the State Department of Agriculture Revolving Fund. Added by Laws 1969, c. 116, § 9.
