A. The marriage of a gestational carrier after she enters into a gestational agreement does not affect the gestational agreement. In such instances, the consent of the person who became the spouse of the gestational carrier after the gestational carrier entered into the gestational agreement is not required in order for the court to validate the gestational agreement, and such person need not be party to the validation proceedings. The spouse of the gestational carrier in such instances shall not be presumed to be the parent of any resulting child. B. The divorce or separation of the gestational carrier and any spouse of the gestational carrier shall not affect the validation or enforceability of such gestational agreement or the ability of the court to validate such gestational agreement that otherwise complies with this act.
