North Dakota Code § 4.1-31-21

Seizure and condemnation

The commissioner may initiate action to seize and condemn a carcass or meat food 
product, or a dead, dying, disabled, or diseased animal that is being transported in intrastate 
commerce, or is held for sale in this state after transportation in intrastate commerce if:
1. The article is or has been prepared, sold, transported, or otherwise distributed or 
offered or received for distribution in violation of this chapter;
2. The article is adulterated or misbranded and not suitable for use as human food; or
3. The article is in any other way violative of this chapter.
