Suspension or revocation of license - Judicial review - Emergency order

Any proceedings under this chapter for the suspension or revocation of a license, or to 
determine compliance with this chapter or the rules and orders of the commissioner, must be 
conducted in accordance with the provisions of chapter 28 -32 and appeals may be made as 
provided. When an emergency exists requiring immediate action to protect the public health and 
safety, without notice or hearing, the commissioner may issue an order reciting the existence of 
the emergency and requiring action be taken to protect the public health and safety. 
Notwithstanding any provision of this chapter, the order is effective immediately, but on 
application to the department an interested person must be afforded a hearing before the 
department within ten days. On the basis of the hearing, the emergency order must be 
continued, modified, or revoked within thirty days after the hearing.
