1. Notwithstanding section 28-21-05, if the judgment debtor is listed on the arrears 
registry as defined in section 14 -09-09.10, or if the judgment debtor meets criteria 
established by the secretary of the United States department of health and human 
services that apply when a financial institution is doing business in two or more states, 
the department of health and human services may issue an execution, against the 
property of the judgment debtor, to the sheriff of any county in which the property may 
be found.
2. A writ of execution issued by the department of health and human services must be 
issued as provided in section 28 -21-06, except the past -due support need not be 
docketed and the writ may be issued in a form prescribed by the department of health 
and human services. A writ issued under this section must be accompanied by a copy 
of the payment records maintained under section 50 -09-02.1 which has been certified 
under section 14-08.1-08.
3. A writ issued by the department of health and human services is returnable to the 
department.
